Acceptance of Terms
Your access to and use of glampalm.com.au, glampalm.co.nz, glampalmaustralia.com or kunahair.com ("the website") is subject exclusively to these Terms and Conditions. You will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the website, including placing any order, you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the website. In any circumstance we reserve all rights. All text and images are protected under the copyright laws. To distribute copyrighted items the party will need to seek permission. Copyrighted text and images cannot be used on 3rd party resale websites unless approved in writing by Kuna Pty Ltd.
This website and domain names are property of Kuna Pty Ltd. All GlamPalm logo's are protected material used under the license issued by Unil Electronics.
The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making any decision.
Freight Protection and Signature On Delivery
Freight Protection: Protection is offered before checkout with every order. This is having the items extra protected with cardboard and bubble-wrap. Freight Protection is in no circumstances refundable.
Signature on Delivery means the delivery driver needs to obtain a signature or bring it to your nearest post office/pick up point for you to collect. GlamPalm Australia is not liable if the parcel was left behind, wrongly delivered or any other circumstance. Signature on Delivery does not include insurance. We do not replace items if they went missing unless the courier has reimbursed us and will pass on the reimbursed amount to the customer in form of a credit.
GlamPalm Australia is released from any liability claims, if a parcel is lost during transit or cannot be delivered, the parcel scanning results fail to show that the delivery has been made to the shipping address provided on your invoice, or but not limited to: you have requested that the delivery driver leaves your parcel unattended at the shipping address provided on your invoice, the packaging has been damaged during transit or has been safe dropped. The parcel was requested to be redirected or delivered to an hospitality or public address.
In the event of an order being incomplete, GlamPalm Australia will need to be notified within 3 days upon receiving the parcel. If, after investigation and camera footage it is shown GlamPalm Australia is at fault, only then the missing product will be replaced.
When you purchase a GlamPalm product, you have the peace of mind in knowing that your product is covered by GlamPalm's Standard Warranty. The GlamPalm Standard Warranty is provided by GlamPalm Australia (ABN 34 161 658 546)and is a domestic warranty only valid within Australia or New Zealand.
The benefits given to you in GlamPalm's Standard Warranty are in addition to other rights and remedies you have under law in relation to the products to which GlamPalm's Standard Warranty relates. GlamPalm products come with guarantees that cannot be excluded under the Australian Consumer Law. Australian customers are entitled to a replacement or refund for a major failure. No refunds are to be given if you have changed your mind, not suitable, decide not to like the product, have no use for it or have discovered the product more cheaply elsewhere. Australian customers are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.
Subject to section above and the terms below, as your Standard Warranty GlamPalm agrees to repair or replace at GlamPalm's cost the GlamPalm product, postage excluded, purchased by you in Australia from a GlamPalm Authorised Dealer when the product does not perform in accordance with the manufacturer's specifications during the Warranty Term of two years for Classic/Clinic Series straighteners and one year for all other electrical tools, commencing from the date of purchase. Accessories include a limited manufacturer's warranty of six months not including any form of physical trauma (breakage or damage not due to defect), wear & tear or abuse.
To make a claim under the Standard Warranty you will need to:
(a). Contact the GlamPalm Australia Call Centre to register your claim and provide the details to enable GamPalm Australia to assess the claim.
(b). Provide or make the product available to GlamPalm Australia Head Office as agreed with GlamPalm Australia. If you are required to return the product to the GlamPalm Australia Head Office, GlamPalm Australia will provide details of the Head Office to you.
(c). Please note, you will need to submit proof of purchase (e.g. bill of sale, invoice or purchase receipt) with your claim.
Products presented for repair may be replaced by refurbished products of the same type rather than being repaired. Refurbished parts may be used to repair the products. Replacement of the product or a part does not extend or restart the Warranty Term.
The product will be at the owner's risk whilst in transit to and from the GlamPalm Australia Head Office, unless transported by GlamPalm Australia or its Authorised representatives.
GlamPalm Australia will not be liable at a customer dispute for any damages of the product without proof the damage happened at the repair centre. GlamPalm Australia is not liable for product damages occured in transit. GlamPalm Australia will pack and protect the product at its best interest.
GlamPalm Australia and its Authorised Service Centres may seek reimbursement of any costs incurred by them when the product is found to be in good working order. GlamPalm Australia will abandon and recycle any product sent to its Head Office after a period of three (3) months where the customer has been contacted but not have taken action to make good.
GENERAL EXCLUSIONS AND LIMITATIONS
* To the full extent permitted by law, but subject always to the above, the Standard Warranty will not apply:
* If the product has not been operated, maintained or used in accordance with the manufacturer's instructions or specifications provided with the product.
* If the factory-applied serial number has been altered or removed from the product.
* To damage, malfunction or failure resulting from alterations, accident, misuse, physical trauma, abuse, fire, liquid spillage, mis-adjustment of customer controls, use on an incorrect voltage, power surges and dips, thunderstorm activity, acts of God, voltage supply problems, tampering or unauthorised repairs by any persons, use of defective or incompatible accessories, exposure to abnormally corrosive conditions or entry by any insect, verminor foreign object in the product.
* To damage arising during transportation, while moving the product, or to any transportation costs of the product or any parts thereof to and from the owner, unless otherwise specified in these warranty terms.
* To any third-party hardware not contained in the product as originally configured by the manufacturer.
* To any failure, to the extent that the failure is not a failure of the product to perform in accordance with its specifications.
* To replacement or repair of any (1) consumables (power cords, cables, caps), or (2) lost parts, or (3) accessories, or (4) name engravings.
* To any gift with purchase including any accessory/consumable (pouch, heat cap, clips) that comes with the purchase of an electrical product.
* To service of any product whilst it is outside Australia and New Zealand.
* To any wear and tear including if the product is used in commercial, industrial, educational or rental applications.
* To any change of colour or staining on the products.
* GlamPalm Australia will not be liable for any loss, damage or alterations to (1) third party hardware; or for any loss or damage arising from loss of use, loss of profits or revenue, or for any resulting indirect or consequential loss or damage.
Consumer Standard Warranty Terms and Special Warranty Conditions
All GlamPalm Classic stylers have a standard 2 year warranty, other electrical products have a standard 1 year warranty. The 2 year warranty for Classic/Clinic Stylers means 1 year manufacturer's warranty plus one year distributors warranty where the iron will be repaired if a problem occurs being the manufacture;s fault. Faulty products, subject to the above, will be replaced or repaired, at the discretion of GlamPalm Australia, if they are still in there warranty period. For service, return your product to GlamPalm Head Office. An additional one (1) year warranty can be purchased for each electrical product.
Changes to the Website
GlamPalm Australia reserves the right to:
change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that GlamPalm Australia shall not be liable to you for any such change or removal; and change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.
Links to Third Party Websites
The website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
All copyright, trade marks and all other intellectual property rights in the website and its content (including without limitation the website design, text, graphics and all software and source codes connected with the website) are owned by or licensed to Kuna Pty Ltd or otherwise used by Kuna Pty Ltd as permitted by law.
In accessing the website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.
Disclaimers and Limitation of Liability
The website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
To the extent permitted by law, Kuna Pty Ltd will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the website.
Kuna Pty Ltd makes no warranty that the functionality of the website will be uninterrupted or error free, that defects will be corrected or that the website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Kuna Pty Ltd for death or personal injury as a result of the negligence of Kuna Pty Ltd or that of its employees or agents.
You agree to indemnify and hold Kuna Pty Ltd and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Kuna Pty Ltd arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
We reserve the right to withdraw any offer at any time or under any circumstances. We reserve the right to fix eventual errors without being liable to you when fixed in a timely manner from being notified. In any circumstances no coupon/promos codes are eliglible or in conjunction with any discounted products. Kuna Pty Ltd will always endavour that the save-reference relate to the product's retail pricing however we reserve all rights in case of errors and rectified in a timely manner. In rare cases this could refer to the "valued at"-pricing.
Purchase orders to New-Zealand are on DTU terms (Duty unpaid). For all import or duty charges please refer to the official New-Zealand government website. For all other shipping information please refer to our shipping policy advertised in the ONLINE STORE.
Kuna Pty Ltd reserves the right not to refund for any "change of mind", "not suitable", "quatity ordered is not correct" or "decide not to like it" situation, misuse or any situation other than manufacturer's fault. It is considered misuse if not using the correct temperature setting. Products bought at expo's, fairs, limited editions or products in promotion, coupon code used or discounted/price matched are final sales and can not be refunded.
Hair irons can be exchanged for an other model number only if the hair iron has not been used, in original condition, purchased on our website and within three (3) days of receiving the product. Hairdryers can not be exchanged. The customer will be liable for all shipping costs involved including the costs paid by Kuna Pty Ltd to transport the order to the customer plus a restocking fee of $28 will apply in any circumstances. Coupon codes cannot be honoured with exchanges. When returning a product with a manufacturer's fault and where GlamPalm would reimburse the customer for freight - in an event such as GlamPalm having dispatched the incorrect item - the reimbursement for freight is capped at $12.50. Personalised products cannot be exchanged at any time. Returns and returned to sender parcels will occur a $20 fee additionally to the restocking fee where applicable. Shipping upgrades, warranty upgrades including PrimeCare+ and/or Accessories are non-refundable at any time. Customers that have bought an electrical product from Kuna Pty Ltd or any other Authorised Retailer can upgrade their electrical product with Primecare+ up to 90 days after its original purchase date. Warranty upgrades display the total warranty time, i.e 3 years warranty means a total of three (3) years on the styler of choice.
GlamPalm Australia reserves all rights to overrule any prices in case of incorrectly displayed due, but not limited to, its synchronization delay.
Social Media advertising which includes synced pricing might occur delays up to 24hrs. GlamPalm Australia reserves all rights to overrule the prices when displayed incorrectly by a 3rd party software.
' Free express shipping qualifies to Australian non-metro customers only. Metro customers qualify for free shipping. All retail orders up to $50 come with a shipping charge. For all trade accounts freight might apply.
*Discounted or promotional items do not come with bonus/free accessories.
*Coupon codes are only applicable on selected products and cannot be applied or redeemed after the payment has been processed. Gift Packs do not qualify at any time for any coupon codes or discounts.
These Terms and Conditions shall be governed by and construed in accordance with the law of Australia and you hereby submit to the exclusive jurisdiction of the Australian courts.
